Terms and Conditions
User Agreement
This User Agreement, which governs your use of the Mawgoud application and application services, is considered a binding contract between you and “Mawgoud”, and you bear responsibility for complying with all agreements that constitute the terms of service of “Mawgoud” through the use of the application, and you undertake not to violate any of the conditions stipulated in the terms of service by reading and accepting this agreement.
Read this Agreement before using Mawgoud Services.
You are not permitted to use the services if you do not understand or agree to this agreement. Clicking to accept this agreement, registering, creating an account, or using the mobile application is not permitted if you do not understand or agree to this agreement.
1. User Policy
1.1 Accounts
To access and utilize some of our Services, you must create an account (“Account”).
Mawgoud must agree to register your account before accessing it, and we reserve the right, for any legal or business reason, to refuse registration to use “Mawgoud” or add any type of account.
1.2 Eligibility
You undertake that you will only use our Services to meet business needs, and that you also warrant that you are of legal age to enter into this Agreement, that you have the necessary training and experience in your chosen field, and that you are at least eighteen years of age.
1.3 Account Profile
Profiles: Unless you modify your privacy settings, you consent to your personal information being displayed to other users and, unless you update your account, to the public. You are required to provide accurate personal information when you register and update your account if your personal information changes. You undertake to correct any false or misleading information about your identity, whereabouts, business, the beneficial owner(s) of your business, your capabilities, or the services you provide. You also undertake not to provide any false or misleading information about any of these matters. If you provide us with inaccurate, outdated, or incomplete information, we reserve the right to suspend or terminate your account.
Provide your current mobile phone number and, if you change it, update your mobile number using the change number feature within the app. You agree to receive text messages, files, and videos (from us or our service providers) with codes to register for our services.
Communication: All communication on the platform should be professional and maintain a courteous tone. Avoid using emojis or excessive informality.
1.4 Identity and location verification
You consent to us from time to time verifying your identity, whereabouts, and business affiliations. Your account will be verified upon registration and on a regular basis after that. This verification process may involve examining one or more official government or legal documents that attest to your identity and location. You agree to promptly furnish us with all relevant information about you and your company upon request. This includes supplying official government or legal documents and assisting us with any other reasonable requests we make to confirm your identity. Certain Account features might be temporarily disabled during verification; if verification is successful, these features will be returned.
1.5 Usernames and passwords
You promise not to disclose your username or password to third parties and to never use someone else's credentials. It is your responsibility to keep your username and password private and secure. You also promise not to disclose them to anyone else. You also agree that if you discover or suspect any unauthorized use of your account or password, you will notify us right away. Additionally, you agree not to use the account or log in using another user's username and password.
2. Relationship with Mawjood
Mawgoud application is an electronic platform that facilitates the process of exchanging information about service providers and clients and buying and selling self-employment services. Our Service is a job marketplace and online directory through which users can communicate with each other. We are not a party to any agreements you may enter into with other users, nor are we directly involved in your negotiations or provision of the Service Providers' services. You are solely responsible for the content you post on Mawgoud and the agreements you enter into with other users, including mutual due diligence and upholding your end of the bargain.
2.1 Connecting You with Other People
We offer you, and are always striving to improve, ways to communicate with other Mawgoud users, including through messages, voice messages, and sending photos and videos. We may provide a suitable platform that enables you to send and receive requests and services to or from other users through our platform. We work with customers and service providers to help us provide ways for you to connect to their services.
2.2 Ways to improve our services
We analyze how you use Mawgoud application in order to improve our services, including helping customers and service providers that use Mawgoud measure the effectiveness and distribution of their services and orders through Mawgoud.
2.3 Communicating with Companies
We provide, and are always striving to improve, ways for you and your service providers to communicate with each other using our services, such as order and transaction information, appointments, and service updates.
2.4 Safety, Security and Integrity
We work to protect the safety, security and integrity of our services. This includes dealing appropriately with abusive people and activities that violate our terms. We work to prohibit abuse of our services including harmful behavior toward others, violations of our terms and policies, and situations where we may be able to help support or protect our community. If we become aware of such users or activities, we will take appropriate action, including removing such users or activities or contacting law enforcement authorities. Any such removal will be in accordance with the “Termination” section below.
3. Contractual Relationship between Client and Service Provider
The relationships you may choose to have with other users are covered in this section, including agreements to buy or sell freelance services to other users.
3.1 Service contracts
It is up to the service provider and the customer, not Mawgoud, to determine the agreements and conclude a service contract. Mawgoud is not responsible or involved in any other service between the service provider and the customer. Rather, the service contract is a direct contractual relationship between the service provider and the customer.
3.2 Disputes among Users
We are not responsible for any disputes that occur between the service provider and the customer. Users are free to pursue the dispute on their own, but Mawgoud has no duty to provide additional support. If a court orders Mawgoud to take action, they must provide five business days' notice, ensure full payment, and cover the cost of the services provided.
The Terms of Service acknowledge that the application acts as a facilitator and cannot guarantee the outcome of disputes.
4. Warranty Disclaimer
The quality, reliability, or safety of our Services are not our responsibility.
Mawgoud and its affiliates offer the services (including content and information) on an "as is" and "as available" basis, and they make no representations or warranties about the services, including that the services will be error-free or uninterrupted. Mawgoud disclaims all implied or statutory warranties, including those regarding title, data accuracy, non-infringement, merchantability, and fitness for a particular purpose, to the fullest extent allowed by applicable law.
5. Limitation of Liability
Any liability we may have to you is limited.
Mawjood disclaims all liability and you agree not to hold us accountable for any losses or damages resulting from or connected to the Terms of Service, including, but not limited to: (i) malfunctions, bugs, errors, or inaccuracies of any kind in our Site or Site Services; (ii) delays or disruptions in our Site or Site Services; (iii) viruses or other malicious software obtained by accessing, or linking to, our Site or Site Services; (v) damage to your hardware device from using the Site or Site Services; (vi) the content, actions, or inactions of third parties’ use of the Site or Site Services; (vii) a suspension or other action taken with respect to your Account; (viii) your reliance on the quality, accuracy, or reliability of job postings, Profiles, ratings, recommendations, and feedback (including their content, order, and display), Composite Information, or metrics found on, used on, or made available through the Site; and (ix) your need to modify practices, content, or behavior or your loss of or inability to do business, as a result of changes to the Terms of Service.
The Mawgoud Parties will not be liable to you for any lost profits or consequential, special, punitive, indirect or incidental damages relating to, arising out of or in any way in connection with our Terms, us or our Services (however caused). On any theory of liability, including negligence, even if the Mawgoud Parties have been advised of the possibility of such damages. Our aggregate liability relating to, arising out of or in any way related to our terms, conditions or services will not exceed the greater of one hundred dollars ($100) or the amount you have paid us in the past twelve months. The foregoing disclaimers of certain damages and limitations of liability will apply to the maximum extent permitted by applicable law. The laws of some states or jurisdictions may not allow the exclusion or limitation of certain damages, so some or all of the above exclusions and limitations may not apply to you. Notwithstanding anything to the contrary in our Terms, in such cases, the liability of the Mawgoud Parties will be limited to the maximum extent permitted by applicable law.
6. Release
You acknowledge that we shall not be liable to you for any dispute that may occur between you and any third parties or clients.
This statement releases Mawgoud, its officers, directors, agents, subsidiaries, joint ventures, employees and service providers from any claims, demands and damages (actual or consequential) of every kind or nature, known or unknown, arising out of or relating to any dispute you may have with another user or third parties, whether at law or in equity, which exists as of the date you enter into this agreement. You acknowledge that Mawgoud is not a party to any contract between users.
We do not control, and are not responsible for controlling, how or when our users use our services or the features, services, and interfaces our services provide. We are not responsible for, and have no obligation to control, the actions or information (including content) of our users or other third parties. Your rights with respect to the Mawgoud Parties are not modified by the foregoing disclaimer if the laws of your country or province of residence, applicable as a result of your use of our services, don't allow it.
7.Projects and Services
Service Providers: Set clear terms for services offered, expertise level, and rates. Deliver projects according to agreed-upon deadlines and maintain open communication with clients.
Clients: Provide a detailed description of project needs and select service providers based on qualifications and experience. Communicate effectively and promptly with chosen service providers.
8. Feedback and Evaluations
Feedback system: After completing the project, clients can leave feedback and ratings on the platform. Feedback must be objective, professional and constructive, and the platform reserves the right to remove any feedback deemed inappropriate or inflammatory.
9. Payment Processing
The Platform might enable payments between clients and service providers through a safe payment processing system.
The platform may charge fees or commissions for using the payment processing system.
10. Compensation
If anyone brings a claim (“Third Party Claim”) against us relating to your actions, information or content on Mawgoud, or any other use of our Services by you, you will, to the maximum extent permitted by applicable law, indemnify and hold the Mawgoud Parties harmless from and against all liabilities, damages, losses and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of or in any way connected with any of the following: (a) your access to or use of our Services, including information and content provided in connection therewith; ; (b) your violation of our Terms or applicable law; or (c) any misrepresentation made by you. You will cooperate as fully as required by us in the defense or settlement of any third-party claim. Your rights in relation to Mawgoud are not modified by the above remedy if the laws of your country or region of residence, which apply as a result of your use of our Services, do not permit it.
11. Acceptable Use of Our Services
11.1 Our Terms and Policies
You must use our Services in accordance with the terms and policies we post. If you violate our Terms and Policies, we may take action against your account, including deactivating or suspending your account, in which case you may not create another account without our permission, and you agree not to do so. Your account will be deactivated or suspended in accordance with the Termination section below.
11.2 Acceptable Legal Use
You must access and use our Services only for lawful, authorized and permitted purposes. You may not use (or help others use) our Services in any way that: (a) infringes, misappropriates or violates the rights (including privacy, publicity, intellectual property or other proprietary rights) of Mawgoud, our users or others; (b) is unlawful, obscene, defamatory, threatening, menacing, harassing, hateful, racially offensive, incites a crime of violence or endangers or exploits children or others; Incites or encourages illegal or inappropriate behavior. (c) coordinated harm related to the dissemination of false or misleading statements; (d) impersonate any person; (e) involves sending illegal or unauthorized messages, such as bulk messaging, automated messages, or automated dialers; or (f) includes non-personal use of our Services, unless we specify otherwise.
11.3 Harming Mawgoud or Our Users
You may not access, use, copy, adapt, modify, create derivative works from, distribute, license, sublicense, transmit, display or perform the Services, directly or indirectly, through automated or other means. You may not use (or help anyone else use) the Service in any way. or in any unauthorized or unauthorized manner, or that overburdens, harms, or harms us, our Services, our systems, our users, or others, whether directly or by automated means. (a) reverse engineer, modify, create derivative works of, decompile or extract any code from our Services; (b) transmit, store or transmit viruses or other harmful computer code to or through our Services; (c) obtain or attempt to gain unauthorized access to our Services or systems; (d) interfere with or disrupt the integrity, security, privacy, integrity, availability or performance of our Services; (e) create accounts for our Services through unauthorized or automated means; (f) collect information from or about our users in any unauthorized manner; (g) sell, resell, rent or otherwise solicit our Services or any data obtained through our Services; (h) distribute or make our Services available over a network for use by multiple devices simultaneously, unless expressly permitted by tools we provide through our Services; (i) create software or APIs that function substantially similar to our Services and make them available to third parties for use in unauthorized ways; or (j) misuse reporting channels, including by submitting fraudulent or unsubstantiated reports or disputes.
12. Availability and Termination of Our Services
We are always striving to improve our services. This means that we may expand, add or remove services, features, capabilities or support for certain devices or platforms. Our service may be interrupted due to maintenance, repairs, upgrades, network or equipment failure, etc. We may discontinue some or all of our Services at any time, including some features and support for certain devices and platforms. Events beyond our control may affect our Services, such as natural disasters or other force majeure events. Articles about Android, iPhone, and KaiOS can be found in our Help Center.
We may modify, suspend or terminate your access to or use of our Services at any time and for any reason, such as if you violate the letter or spirit of our Terms or cause harm, risk or potential legal exposure to us, our users or others. We may also deactivate or delete your account if it does not become active after account registration or if it remains inactive for an extended period of time. The following provisions will survive any termination of your relationship with Mawgoud: “Licenses,” “Warranty Disclaimers,” “Limitation of Liability,” “Indemnification,” “Availability and Termination of Our Services,” and “Other.”
13. Licenses
13.1 Your Rights
Mawgoud does not claim ownership of the information you submit for your Mawgoud account or through our services. You must have the necessary rights to such information that you submit for your Mawgoud account or through our Services and the right to grant the rights and licenses set forth in our terms.
13.2 Mawgoud Rights
We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks (or any similar marks), domains, logos, trade dress, trade secrets, patents and other intellectual property rights unless you obtain our express permission except in accordance with our Brand Guidelines. You may use our affiliates' trademarks only with their permission, including as permitted in any published trademark guidelines.
13.3 Your License to Mawgoud
In order to operate and provide our Services, you grant Mawgoud a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, create derivative works of, display and perform the Information (including Content) that you upload, submit, store, transmit or receive on or through our Services. The rights you grant in this license are for the limited purpose of operating and providing our Services (such as allowing us to display your profile photo and status message, and to transmit your messages and responses to requests).
13.4 Mawgoud License to You
We grant you a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to use our Services, in accordance with and subject to our Terms. This license is for the sole purpose of enabling you to use our Services in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.
14. Severability
Any clause found to be invalid or unenforceable under these TOS will be removed, leaving the remaining clauses in full force and effect.
15. Changes to TOS
The Platform reserves the right to update these terms any time.
16. Other Important Conditions
Unless a mutual agreement between you and us provides otherwise, our Terms constitute the entire agreement between you and us in relation to Mawgoud and our Services, and supersede any prior agreements.
We reserve the right to determine in the future that certain of our Services are governed by separate terms (which, where applicable, you may agree separately).
Our Services are not intended for distribution or use in any country or territory where such distribution or use would violate local law or which would subject us to any regulations in another country or territory. We reserve the right to limit our Services in any country or territory.
Our Terms are written in English (US). Any translated version is provided solely for your convenience. To the extent that any translated version of our Terms conflicts with the English version, the English version controls.
Any modification or waiver of our terms proposed by you requires our express consent.
All of our rights and obligations under our Terms are freely assignable by us to any of our affiliates or in connection with a merger, acquisition, restructuring or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates or entities. Suffix or new owner. If such an assignment occurs, these Terms will continue to govern your relationship with that third party. We hope that you will continue to use our Services, but if you do not agree to such assignment, you must stop using our Services by deleting your account after being notified of the assignment.
You will not transfer any of your rights or obligations under our terms to any other person without our prior written consent.
Nothing in our terms prevents us from complying with the law.
Except as provided herein, our Terms do not confer any third-party beneficiary rights.
If we fail to enforce any of our terms, it will not be considered a waiver.
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed modified to the minimum extent necessary to make it enforceable, and if it is not so enforceable, it will be deemed severable from our Terms and not Affect the validity and enforceability of the remaining provisions of our Terms,
We reserve all rights not expressly granted to you. You may have statutory rights as a consumer, and our terms are not intended to limit a consumer's statutory rights that may not be waived under contract.
We always appreciate your comments or other suggestions about Mawgoud and our Services, but you understand that you have no obligation to provide comments or suggestions and that we may use your comments or suggestions without any restriction or obligation to compensate you for them.
